Terms & Conditions

 In the terms and conditions set out below “Terms” any reference to “TopInk ” is a reference to TopInk NZ.



* TopInk NZ reserves the right to modify and vary these Terms at any time.

* TopInk NZ is the trading name of Seamark International Limited.Seamark International Limited is a New Zealand registered company. GST registered No.84687265.

1. PRICE

1.1 TopInk may alter prices of the products without prior notice.

1.2 All prices list on TopInk are in New Zealand Dollar.

2. PAYMENT

2.1 Unless TopInk NZ has agreed to extend credit to the buyer, payment is to be made in cash with order.

2.2  TopInk accepts Visa and MasterCard online payment, Bank transfer and deposit.

2.3 Payment by cheque or by any type of bank deposit will not be considered payment until the payment has been fully cleared.
 

3. RISK AND DELIVERY

3.1 TopInk use overnight courier service to deliver within New Zealand. However, according to NZ CourierPost, Rural Delivery could take 2-3 days to reach. Mostly, courier service delivery arrives the next day of dispatch except weekend and public holiday.

3.2 TopInk NZ charges only $1 for delivery for all inkjet cartridges orders regardless order quantity; postage for other products depends on size and location.

3.3 All claims for shortage or damage during delivery must be made to both the carrier and TopInk NZ immediately and at the latest within 48 hours of the date of delivery.

3.4 TopInk NZ will make every effort to ensure delivery of Products, or performance of services,  is on time but will not be liable to the buyer for any loss or damage arising in any way from any delay in delivery or performance.

4. RETENTION OF TITLE

4.1 Notwithstanding any period of credit, ownership of Products remains with TopInk NZ and will not pass to the buyer until those Products supplied to the buyer have been paid for in full.

4.2 the buyer must not represent to any third party that the buyer are in any way acting for TopInk  NZ, and TopInk NZ is not bound by any contract between the buyer and any third party.

5. CLAIMS AND LIABILITY

5.1 TopInk NZ guarantees its products to be free from manufacturer defects. Liability under this warranty is limited to the replacing of any product found to be defective under normal use. For     the avoidance of doubt, TopInk NZ shall have no obligation to provide refunds.

5.2  TopInk NZ will not be liable in any event for any loss or damages of any kind, whether direct, or special, or indirect or consequential, howsoever arising, whether or not TopInk NZ had knowledge that such damages might be incurred, including but not limited to loss of income,        profit, interest, opportunity, utility or loss of market, incurred by the buyer or by any third party.

5.3  15% restocking fee will apply for all returned goods (not include defective products). Freight is non-refundable in the case of returns.

5.4  Nothing in these Terms shall exclude or restrict any rights or remedies the buyer may have under the Fair Trading Act 1986.

 

6. WARRANTY TERMS

6.1 All items have 6mths RTB Warranty unless otherwise stated. TopInk NZ doesn't responsible for the cost of goods return.

6.2 Shipping is not refundable (sorry as it is paid to a THIRD PARTY and not to us).

6.3 Replacement item will be sent once the returned item been received, inspected & tested. Must be returned in original condition with all packaging.

6.4 Warranty is void if factory labels are removed, physical damage, dismantling, tampering)

7. INTELLECTUAL PROPERTY

7.1 The buyer shall not use any trade marks which are the property of TopInk NZ or its Suppliers, or any similar words or marks, or any combination of words which includes any of those trade marks or any similar words or marks.

8. LAW

These Terms are governed by the laws of New Zealand and any dispute under them shall be subject to the jurisdiction of the Courts of New Zealand.
